The city of Peoria has negotiated a tentative $1.5 million settlement to end a lawsuit filed by the family of murder victim Kayla Fannon.
Fannon was killed by David Jenkins in a murder-suicide in her south Peoria home in February 2019.Fannon called 911 before the murder to report Jenkins was harassing her. That included Jenkins, a convicted felon, texting photos of himself holding a handgun with his face partially obscured to Fannon.
Peoria Police Officer Joseph Harris found an old order of protection Fannon filed against Jenkins on file, but told her he couldn't arrest him because he wasn't identifiable in the photo. He reportedly told Fannon to get a new order of protection and to relocate to a safe place if she felt like she was in danger.
About seven hours after Fannon called 911, Jenkins came to the home, fatally shooting both Fannon and himself.
Fannon's aunt, Marni Jo Rora, filed suit against Harris and the city in March 2019, alleging Harris had probable cause to arrest Jenkins, and should have also transported Fannon to a safe place under the Illinois Domestic Violence Act.
If the Peoria City Council votes to approve the settlement at its regularly scheduled meeting next Tuesday, the city would pay about $890,000 to Fannon's estate. The rest of the balance would be paid off by the city's insurer.
Fannon left behind four young children.
