Lawsuit dropped after settlement in Bloomington wrongful death case

A wrongful death lawsuit filed in McLean County has been dismissed after the victim's family received an insurance settlement.

The family of Corey Cottrell, 39, of Normal, sued the driver of the van and the van’s owner following the 2019 crash south of downtown Bloomington.

The van driver, Jose Rodriguez, who is now 33, is serving a seven-year prison sentence for failure to report an accident, according to online court records.

Cottrell’s family is set to receive insurance payouts of $200,000, according to an attorney involved with the case.

Cottrell was riding a motorcycle that was struck and killed by a van Rodriguez was driving near Main Street and MacArthur Avenue. The lawsuit alleged Rodrigues ran a red light, drove over Cottrell as he lay on the pavement and then fled the scene.

The lawsuit was filed against Rodriguez and the van’s owner, GR Framing Construction and German Javier Rodriguez. The lawsuit alleged they should have known Rodriguez did not have a valid driver’s license.
